

The Office of Energy advises the Government through the Minister for Energy, on two intergovernmental agreements. Aside from overseeing the operation of these agreements, the Office of Energy is involved in the implementation of commitments under these agreements and the representation of State interests.
The Council of Australian Governments (CoAG) Natural Gas Pipelines Access Agreement was signed on 7 November 1997, and sets out the obligations of jurisdictions to implement and maintain the integrity of the National Third Party Access Code for Natural Gas Pipeline Systems, which regulates third party access to natural gas transmission and distribution pipelines throughout Australia.
The Australian Energy Market Agreement was signed on 11 December 2003, and underpins the energy market reforms agreed to by the Ministerial Council on Energy. This has resulted in further reforms to the energy market in Australia and the establishment of new national energy governance and regulatory arrangements. The Australian Energy Regulator (AER) regulates aspects of the Australian energy sector and Australian Energy Market Commission (AEMC) which looks after market development and Code changes.
The AER does not apply to Western Australia, as the Economic Regulation Authority regulates the electricity, gas, water and rail freight industries in this State. The AEMC will apply to gas pipeline access in Western Australia, in light of the States application of the Gas Pipelines Access Law and the National Gas Code. The AEMC will take on the rule-making and market development functions currently performed by the National Gas Pipelines Advisory Committee and the Code Registrar.
